Animation issues

Im having trouble with some moving animations, more specifically the same animation plays differently in 3ds max then it does in oblivion(legs float and move for no reason) and this is because i think oblivion doesent use pelvis as the mesh origin point but something else.. anybody have a clue what it is?

So apparently the first spine bip also moves legs for whatever reason, staying clear of that bip and everything works
